These Terms of Use (“Terms”) govern your access to and use of the money-transfer and mobile-money services provided by Tyndill Financial Services Ltd (“Tyndill”, “we”, “us”) through the Tyndill app, our WhatsApp service, our website, and our branch in Kigali (together, the “Service”). By registering for or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. The Service

Tyndill facilitates the transfer of funds and mobile-money transactions between Rwanda and other countries. You may request transfers through the Tyndill app, on WhatsApp, or at our branch. All transfers are subject to verification, applicable law, and these Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You must provide accurate, current, and complete information about yourself and any recipient, and keep it up to date.

3. Your account

To use the app you may register an account using your WhatsApp number and email. You are responsible for keeping your log-in credentials secure and for activity under your account. Notify us immediately of any unauthorized use. Each account must use a unique email address.

4. How transfers work

• You submit a transfer request with the amount, destination, and recipient details;
• You pay in the funds and provide proof of payment where requested;
• We verify the payment, then process the transfer to the recipient via bank or mobile money;
• On completion we issue you a receipt and, for external transfers, the proof of the transfer we made to the destination.

5. Exchange rates & fees

Exchange rates and any fees are set by Tyndill and are applied at our official rate at the time your transfer is processed. Rates fluctuate and any rate quoted in advance is indicative only. The amount the recipient receives depends on the rate and fees applied at processing.

6. Your obligations

• Ensure the funds you transfer are lawfully obtained and yours to send;
• Provide accurate recipient details — we are not responsible for funds sent to an incorrect recipient due to details you provided;
• Provide identification and information we reasonably require for verification and compliance;
• Use the Service only for lawful purposes.

7. Prohibited use

You must not use the Service for money laundering, terrorist financing, fraud, transfers to or from sanctioned persons or countries, or any illegal activity. We may decline, delay, freeze, or reverse any transaction that we reasonably believe breaches these Terms or applicable law.

8. Compliance & monitoring

Tyndill complies with Rwanda’s anti-money-laundering and counter-terrorist-financing laws and with the data-protection framework overseen by the National Cyber Security Authority (NCSA). We may verify your identity, request the source of funds, monitor transactions for suspicious activity, and report to the relevant authorities where required by law.

9. Processing & timing

We aim to process transfers promptly. Timing can vary depending on the destination, the recipient’s bank or mobile-money registration, verification requirements, and factors outside our control. We do not guarantee a specific delivery time.

10. Cancellations & refunds

A transfer may be cancelled or refunded only if it has not yet been paid out to the recipient and subject to any costs already incurred and applicable law. Refunds are returned to the original payer. Contact us as soon as possible if you need to cancel a transfer.

11. Liability

We provide the Service with reasonable care and skill. To the extent permitted by law, Tyndill is not liable for indirect or consequential loss, for delays or failures caused by third parties (such as banks, mobile-money operators, or messaging providers), or for losses arising from inaccurate details you provided. Nothing in these Terms excludes liability that cannot be excluded under Rwandan law.

12. Suspension & termination

We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or to protect against fraud or risk. You may stop using the Service at any time, subject to completion of any pending transactions and our record-keeping obligations.

13. Governing law

These Terms are governed by the laws of the Republic of Rwanda. Any dispute will be subject to the competent courts of Rwanda, without prejudice to any mandatory consumer protections.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date shows the latest version, and continued use of the Service after changes take effect means you accept the updated Terms.
